Insurance Coverage Basics for Mediation

Insurance lurks underneath the surface of a wide array of disputes and lawsuits. It often funds defendants’ litigation efforts and settlement payments. Unbeknownst to plaintiffs, there may be disputes between defendants and their insurers or ticking time-bomb coverage issues waiting to blow up just as the parties agree to settlement negotiations. Understanding the basics of liability insurance and how it might impact the resolution of disputes is critical for litigators and mediators alike. This presentation will provide an introduction into types of common liability coverages, key insurance law concepts and policy conditions, and insurers’ informational needs and incentives. It will give attorneys and neutrals the basic tools to start tackling more nuanced and complex settlement dynamics involving liability insurance.

Tyler Gerking helps policyholders maximize their insurance assets. He works with them and their insurance brokers in negotiating favourable terms to address their unique risks. He also pursues insurance claims, shepherding policyholders through the claim process and if necessary, pursuing breach of contract and bad faith claims against insurers in litigation and arbitration settings. He frequently works with cyber, errors & omissions liability (E&O), directors & officers liability (D&O), general liability (CGL), employment practices liability (EPL), crime and property insurance.

Dan Kohane is a nationally recognized insurance coverage counselor who conducts extensive training, consultation and in-house seminars on this highly specialized practice. For over 30 years, he has served as Adjunct Professor of Insurance Law at the University at Buffalo Law School. Mr. Kohane is also known in the industry for his comprehensive newsletter, Coverage Pointers, a bi-weekly publication summarizing important insurance coverage decisions in New York State courts with overviews of other jurisdictions.
