Mediation and Cannabis

Recent years have seen an exponential upswing in countries and states legalising some aspects of the use of the cannabis plant - be it for medical, recreational or wellness purposes. One result of this rapid growth, however, is the uncertainty and complexity in dealing with the legal and other aspects of this industry. There are unexpected issues of legality and illegality across borders, questions of social equity, power imbalances between parties and intersections of different cannabis cultures for which mediation often emerges as the optimal method of conflict transformation. Join us as we explore the basics of this burgeoning industry and the contribution mediation can make as the field develops.

About our Speaker:

Ambassador (ret.) Menahem Chuck Kanafi is a former career diplomat and lawyer. During thirty years of civil service, he served in Zimbabwe, Germany, India, Turkey and United Nations Headquarters in New York, and held Ambassadorial positions in Eritrea and Ghana. Over the course of his career, he negotiated numerous international agreements, the most important of which include: the civil provisions of the 1995 Oslo II agreements between Israel and the PLO; the Israel-Jordan Peace Treaty (1994); the German Fund for Compensation of Nazi-Era Slavery and Forced Labourer agreement, and multiple economic and agricultural development treaties.

Ambassador Kanafi currently acts as a neutral mediator for cross-border commercial disputes involving South Asia, Israel, and the EU. In particular, he specialises in cases with substantial intercultural elements.

He is a Certified Mediator under German law, and is included in the panel of commercial mediators of the Berlin Chamber of Commerce and Industry.

In addition to his practice in Berlin, Ambassador Kanafi is associated with CAMP Mediation, Bangalore, India, and is a frequent lecturer on ADR in the cannabis industry in the framework of the International Cannabis Bar Association. He is also a familiar face as an expert assessor and judge at international mediation and negotiation competitions.

His pro bono legal activities include mediating at the MediationsZentrum-Berlin Community Mediation Centre (primarily providing access to justice for low-income parties).
