Mediating Data Breach, Privacy, Ransomware & Cyber Insurance Claims
Data breaches, ransomware claims and their related insurance and indemnity issues have become the "new normal" for life in the past decade. Most Americans have had personal information compromised in one or more of the massive data breaches that have occurred and it is often said that it is not a matter of "if" but a matter of "when" that any particular business or entity will become a victim of a cyber incident or data breach. The EU enacted the GDPR and states in the US are considering and enacting statutes to protect the privacy of citizens. Claims and lawsuits follow losses, with mediations being held both pre-and post- filing of suits. Words, phrases, exposures, available insurance, indemnity obligations - please join us as we explore this area of the law and resolution of the claims that result.
Jean M. Lawler, a commercial and insurance mediator based in Los Angeles, is well-familiar with the intersecting fields of privacy and cyber related losses and claims, both as an advocate and as a mediator. Ms. Lawler first became involved in this area when in private practice, when the field was in its relative infancy, handling cases involving situations such as an escrow company who was taken in by an email to wire escrow funds to a bad actor's bank and a major property management company being sued for alleged TCPA violations. With the rise in ransomware and data breach claims, and understanding the value that a knowledgeable mediator could bring to these claims, she used time during the pandemic lockdown to accomplish her goal of becoming certified as an Information Privacy Professional (CIPP) by IAPP. A full time mediator since 2017, Ms. Lawler mediates privacy, data breach and ransomware claims.
When in practice, Ms. Lawler was a Senior Partner of a Los Angeles based litigation firm with a diverse and international practice, representing corporations, professionals, non-profits, individuals, and insurers in a broad range of matters, at trial and on appeal. She also served as Managing Partner of the firm from 2008 through 2013.
A believer in giving back to the legal community, Ms. Lawler is a past president of both the Federation of Defense & Corporate Counsel and the Insuralex Global Insurance Group (Chamber ranked Band 1 for Insurance) and is a Fellow and founding Regent of the American College of Coverage Counsel. As President of the FDCC, together with Donna Melby, then National President of ABOTA, she co-founded the inaugural “National Summit on the Right to Trial by Jury”, 2005 (now ABOTA’s 7th Amendment Summit).
Recently elected to membership in the National Academy of Distinguished Neutrals, Ms. Lawler is rated AV-Preeminent by Martindale. She has also been recognized by Women Leaders in the Law, Southern California Top Women Lawyers since inception in 2011 (in 2016, was one of only 20 for Insurance Coverage) and Super Lawyers since 2006.
