Access to Justice in North America- What We Are Missing

Access to Justice is the foundation to the administration of justice in most parts of the world. It means many things to all stakeholders involved – society in general, government, parties in dispute, the legal profession and our courts. As recently stated (2018) by the Right Honourable Richard Wagner, P.C. – Chief Justice of Canada – “ … Ultimately, it is about getting good justice for everyone, not perfect justice for a lucky few. It’s a democratic issue. It’s a human rights issue – It’s even an economic issue … “.

Until recently, the delivery of acceptable Access to Justice was the exclusive domain of our courts and traditional litigation. Over the past decade in particular private dispute resolution has emerged in Canada, the United States, the U. K. and elsewhere as a significant parallel system to traditional litigation. With this shift comes a concurrent responsibility for lawyers and professionals serving as mediators to appreciate and discharge our work to a standard that not only maintains but indeed enhances Access to Justice for all.

The exploding demand for and use of private dispute resolution services, while encouraging, has also revealed less than optimum understanding and utilization of these dispute resolution platforms by counsel, clients, mediators and arbitrators.

Please join Ivan for a high-level discussion of Access to Justice in the context of mediation, what course corrections are essential to shoring up both the integrity and effectiveness of mediations, sensitizing both lawyers and mediators to the heavy-duty resting on us to understand and maximize the delivery of quality Access to Justice to parties in all forms of dispute.

Ivan Derer, from his base in Calgary, Alberta, has pursued a diverse litigation and dispute resolution practice that spans the areas of insurance, professional negligence, construction, products liability, estate, personal injury, life and disability, matrimonial matters as well as high-end energy and commercial disputes for close to 40 years. Since obtaining his LL.M. from Osgoode Hall Law School in ADR in 2006, Ivan's practice is now focused exclusively on retainers as mediator and arbitrator. Ivan has conducted over 3,000 mediations across Western Canada and numerous arbitrations.

Ivan is also committed to pursuing and promoting best practices in the field of private dispute resolution. Ivan makes himself available to provide advice, consulting services in all aspects of mediation and arbitration practices including resolution strategies, process design and standard of care considerations for both mediators and counsel.
